Is a Trust Needed?  Learning About Your Specific Estate Planning Needs

At the outset of our engagement, I will want to learn about you, your family, the nature of your assets and estate, and your estate distribution wishes.  At this point, we can determine whether a trust might additionally be beneficial, or whether a will alone might be the better option.

For more information, see Do I Need a Trust?

It’s important to understand that even if a trust is desirable, a will is still necessary to dispose of any assets that that may be owned you at death, and which are not otherwise distributed by operation of law, or held by a trust.

My Focus – Creating an Affordable and Simple Estate Distribution Plan around Your Interests

Once a determination has been made about whether a trust is necessary, my role is to carefully document your estate distribution wishes.  It is important that provision is made to fully dispose of all assets, and, for key assets that may have great sentimental value, to ensure that these assets are distributed to specific people.  If distribution potentially will not be made until a later time (such as until a child or grandchild reaches a specified age), then a trust may need to be created that will cover your wishes.
